5 verses

When a man levels the charge of adultery against his own wife but brings no witnesses to back his claim, the Quran establishes a precise mechanism to break the stalemate. Rather than leaving the accusation hanging in unresolved suspicion, the verses in Surah An-Nur lay out a sequence of heavy, reciprocal oaths. This process shifts the burden of proof from earthly investigations to a direct invocation of divine judgment. By demanding multiple sworn testimonies from both spouses, the text creates a stark confrontation between husband and wife where the only remaining witness is God.

How does a husband swear to an accusation without witnesses?

If a husband stands as his own sole witness to his wife's infidelity, the Quran requires him to testify repeatedly under oath. He must call upon God four separate times to witness that he is telling the truth about his charge (24:6). This forced repetition ensures the accusation cannot be a hastily spoken insult; it must be a deliberate, measured testimony. Following these four statements, the husband must issue a fifth and final oath. In this culmination, he explicitly calls down God's rejection upon himself if he happens to be lying (24:7). By staking his spiritual standing and inviting a divine curse on his own head, the husband's fivefold testimony substitutes for the external witnesses he could not provide.

How does the wife defend herself against the charge?

The husband's severe oaths do not automatically convict the wife or seal her fate. The Quran immediately provides her with an exact, symmetric counter-measure to avert any punishment. She is given the floor to testify in her own defense, following the identical structure of repeated oaths (24:8). She must swear by God four separate times that her husband is lying. Finally, to complete her defense and entirely block the accusation, she issues her own fifth oath. She calls God's rejection down upon herself if her husband is actually telling the truth (24:9). Once she completes these five statements, the legal procedure ends, and the earthly punishment is formally averted.

What resolves the contradiction between the oaths?

After detailing these ten severe oaths, the text does not mandate further interrogation to find out which spouse actually lied. Instead, the sequence immediately pivots away from the procedure to highlight the overarching context of divine grace. The passage states that were it not for God’s bounty and mercy toward the people, the consequences of such intimate betrayals and false oaths would be devastating (24:10). The matter is taken out of human hands entirely, leaving the ultimate verdict to the unseen.

By establishing these reciprocal testimonies, the verses construct an exit from an impossible marital deadlock, ensuring that neither an unproven accusation nor a genuine transgression drags the community into endless litigation. The final word on the matter hangs intentionally open in the text. The procedure closes only by reminding the swearing parties of the divine presence, leaving them with the reality of a God who accepts repentance and remains endlessly wise (24:10).

24:6 An-Nur

As for those who accuse their own wives of adultery, but have no other witnesses, let each one four times call God to witness that he is telling the truth,

24:7 An-Nur

and, the fifth time, call God to reject him if he is lying;

24:8 An-Nur

punishment shall be averted from his wife if she in turn four times calls God to witness that her husband is lying

24:9 An-Nur

and, the fifth time, calls God to reject her if he is telling the truth.

24:10 An-Nur

If it were not for God’s bounty and mercy towards you, if it were not that God accepts repentance and is wise . . .!
