Divorce

22 verses

Detailing the mechanics of marital separation (al-Talaq) across 22 verses, the text maps out exact rules for waiting periods, financial rights, and the prevention of harm. Categorized broadly under relationships with people, these verses construct a framework where ending a marriage demands the same fairness that began it. Rather than an abrupt severing, the separation must follow a measured schedule that protects vulnerable parties from being rushed or exploited.

How does the process of separation unfold? The text sets strict boundaries on how and when a marriage ends. It decrees that "divorce can happen twice," after which a wife must be either "kept on in an acceptable manner or released in a good way" (2:229). As noted in Mawsu'at al-Tafsir al-Mathur (4/173), this verse establishes the definitive limit for pronouncements, dismantling any practice of endless separations. Following a divorce, women must wait three monthly periods before remarrying (2:228). During this window, husbands are instructed to take them back if they wish to put things right, though they are explicitly forbidden from holding onto their wives "with intent to harm them and commit aggression" (2:231). For a husband who swears an oath not to approach his wife, a maximum waiting period of four months is imposed to either return or finalize the break (2:226). If a couple fears a breakdown before any divorce occurs, they must appoint one arbiter from his family and one from hers; if the pair wants to reconcile, God will bring it about (4:35).

What happens to the dowry and financial support? Financial protections for the divorced woman center heavily on preserving her bride-gift and ensuring her maintenance. Men are forbidden from treating wives harshly in hopes of forcing them to surrender their bride-gift (4:19). If a husband decides to replace one wife with another, he cannot take back any of her dowry, even if he had given her "a great amount of gold" (4:20). The sole exception occurs if both parties fear they cannot maintain God’s bounds, in which case the woman may opt to give something for her release (2:229).

If a divorce takes place before consummation, financial obligations adjust but do not disappear. When a bride-gift was already fixed, the husband owes half, though waiving this right is described as "nearer to godliness" (2:237). If the marriage was unconsummated and no dowry was fixed, the husband must still provide a fair provision—the wealthy according to his means, and the poor according to his (2:236). As Abu Zahra observes regarding these early separations (Zahrat al-Tafasir, 2/827), the absence of blame for divorcing before consummation does not erase this strict duty of provision.

Who provides for the children after divorce? The text isolates the rights of children from the disputes of their parents. Divorced mothers have the right to nurse their children for two whole years, during which the father must bear the costs of the mother’s clothing and maintenance in a fair manner (2:233). The overarching rule governing this arrangement is that "no mother shall be made to suffer harm on account of her child, nor any father on account of his" (2:233). If the parents mutually agree through consultation to wean the child early, or if they decide to hire a wet-nurse, they incur no blame as long as the father pays the agreed wage fairly (2:233).

When a wife fears high-handedness or alienation from her husband, the two are urged to reach a peaceful settlement, acknowledging that peace is best even when human souls lean toward selfishness (4:128). The baseline standard for all such marital strain is to live with women in accordance with what is fair and kind, retaining the awareness that a husband might dislike his wife while disliking something in which God has put much good (4:19).

2:226 Al-Baqarah

For those who swear that they will not approach their wives, there shall be a waiting period of four months:if they go back, remember God will be most forgiving and merciful,

2:228 Al-Baqarah

Divorced women must wait for three monthly periods before remarrying, and, if they really believe in God and the Last Day, it is not lawful for them to conceal what God has created in their wombs: their husbands would do better to take them back during this period, provided they wish to put things right. Wives have [rights] similar to their [obligations], according to what is recognized to be fair, and husbands have a degree [of right] over them: [both should remember that] God is almighty and wise.

2:229 Al-Baqarah

Divorce can happen twice, and [each time] wives either be kept on in an acceptable manner or released in a good way. It is not lawful for you to take back anything that you have given [your wives], except where both fear that they cannot maintain [the marriage] within the bounds set by God: if you [arbiters] suspect that the couple may not be able to do this, then there will be no blame on either of them if the woman opts to give something for her release. These are the bounds set by God: do not overstep them. It is those who overstep God’s bounds who are doing wrong.

2:231 Al-Baqarah

When you divorce women and they have reached their set time, then either keep or release them in a fair manner. Do not hold on to them with intent to harm them and commit aggression: anyone who does this wrongs himself. Do not make a mockery of God’s revelations; remember the favour He blessed you with, and the Scripture and wisdom He sent to teach you. Be mindful of God and know that He has full knowledge of everything.

2:233 Al-Baqarah

Mothers suckle their children for two whole years, if they wish to complete the term, and clothing and maintenance must be borne by the father in a fair manner. No one should be burdened with more than they can bear: no mother shall be made to suffer harm on account of her child, nor any father on account of his. The same duty is incumbent on the father’s heir. If, by mutual consent and consultation, the couple wish to wean [the child], they will not be blamed, nor will there be any blame if you wish to engage a wet nurse, provided you pay as agreed in a fair manner. Be mindful of God, knowing that He sees everything you do.

2:236 Al-Baqarah

You will not be blamed if you divorce women when you have not yet consummated the marriage or fixed a bride-gift for them, but make fair provision for them, the rich according to his means and the poor according to his- this is a duty for those who do good.

2:237 Al-Baqarah

If you divorce wives before consummating the marriage but after fixing a bride-gift for them, then give them half of what you had previously fixed, unless they waive [their right], or unless the one who holds the marriage tie waives [his right]. Waiving [your right] is nearer to godliness, so do not forget to be generous towards one another: God sees what you do.

2:241 Al-Baqarah

Divorced women shall also have such maintenance as is considered fair: this is a duty for those who are mindful of God.

4:19 An-Nisa

You who believe, it is not lawful for you to inherit women against their will, nor should you treat your wives harshly, hoping to take back some of the bride-gift you gave them, unless they are guilty of something clearly outrageous. Live with them in accordance with what is fair and kind: if you dislike them, it may well be that you dislike something in which God has put much good.

4:20 An-Nisa

If you wish to replace one wife with another, do not take any of her bride-gift back, even if you have given her a great amount of gold.

4:35 An-Nisa

If you [believers] fear that a couple may break up, appoint one arbiter from his family and one from hers. Then, if the couple want to put things right, God will bring about a reconciliation between them: He is all knowing, all aware.

4:128 An-Nisa

If a wife fears high-handedness or alienation from her husband, neither of them will be blamed if they come to a peaceful settlement, for peace is best. Although human souls are prone to selfishness, if you do good and are mindful of God, He is well aware of all that you do.

4:130 An-Nisa

but if husband and wife do separate, God will provide for each out of His plenty: He is infinite in plenty, and all wise.

33:49 Al-Ahzab

Believers, you have no right to expect a waiting period when you marry believing women and then divorce them before you have touched them: make provision for them and release them in an honourable way.

58:3 Al-Mujadila

Those of you who say such a thing to their wives, then go back on what they have said, must free a slave before the couple may touch one another again––this is what you are commanded to do, and God is fully aware of what you do––

58:4 Al-Mujadila

but anyone who does not have the means should fast continuously for two months before they touch each other, and anyone unable to do this should feed sixty needy people. This is so that you may [truly] have faith in God and His Messenger. These are the bounds set by God: grievous torment awaits those who ignore them.

58:22 Al-Mujadila

[Prophet], you will not find people who truly believe in God and the Last Day giving their loyalty to those who oppose God and His Messenger, even though they may be their fathers, sons, brothers, or other relations: these are the people in whose hearts God has inscribed faith, and whom He has strengthened with His spirit. He will let them enter Gardens graced with flowing streams, where they will stay: God is well pleased with them, and they with Him. They are on God’s side, and God’s side will be the one to prosper.

65:1 At-Talaq

Prophet, when any of you intend to divorce women, do so at a time when their prescribed waiting period can properly start, and calculate the period carefully: be mindful of God, your Lord. Do not drive them out of their homes––nor should they themselves leave––unless they commit a flagrant indecency. These are the limits set by God–– whoever oversteps God’s limits wrongs his own soul––for you cannot know what new situation God may perhaps bring about.

65:2 At-Talaq

When they have completed their appointed term, either keep them honourably, or part with them honourably. Call two just witnesses from your people and establish witness for the sake of God. Anyone who believes in God and the Last Day should heed this: God will find a way out for those who are mindful of Him,

65:4 At-Talaq

If you are in doubt, the period of waiting will be three months for those women who have ceased menstruating and for those who have not [yet] menstruated; the waiting period of those who are pregnant will be until they deliver their burden: God makes things easy for those who are mindful of Him.

65:6 At-Talaq

House the wives you are divorcing according to your means, wherever you house yourselves, and do not harass them so as to make their lives difficult. If they are pregnant, maintain them until they are delivered of their burdens; if they suckle your infants, pay them for it. Consult together in a good way- if you make difficulties for one another, another woman may suckle the child for the father––

66:5 At-Tahrim

His Lord may well replace you with better wives if the Prophet decides to divorce any of you: wives who are devoted to God, true believers, devout, who turn to Him in repentance and worship Him, given to fasting, whether previously married or virgins.
